What is processing?

“Processing” means any operation or set of operations which is performed upon Personal Information, whether or not by automatic means. The term is broad and covers virtually any handling of data.

Who is responsible for data processing?

What are the legal bases of processing?

We only process your Personal Information if we have to have at least one of the reasons:

  • Consent – This is where we have asked you to provide explicit permission to process your data for a particular purpose. 
  • Contract – This is where we process your information to fulfill a contractual arrangement, we have made with you or reply to your messages, emails, calls, etc. 
  • Legitimate Interests – This is where we rely on our interests as a reason for processing, generally this is to provide you with the best products and service in the most secure and appropriate way. Of course, before relying on any of those legitimate interests we balance them against your interests and make sure they are compelling enough and will not cause any unwarranted harm.
  • Legal Obligation – This is where we have a statutory or other legal obligation to process the information, such as for archiving or the investigation of crime.

 

Data we collect automatically

Log data

Even if you do not log in or register on our website, but simply browse our website, data is collected and stored and processed by us. Specifically, this requires the IP address of your computer, Date and time of access, Name and URL of the accessed file, Browser used, Number of bytes transferred, Status of the page retrieval, Session ID, Referrer URL.

Hosting 

The hosting service used for the purpose of operating my website is Bluehost (Newfold Digital Inc). In doing so Bluehost processes all data and communication data of our customers, interested parties and visitors of our website and services that are provided through the website. 

Cookies

We use so-called cookies on our website. Cookies are pieces of information that are transmitted from our web server or third-party web servers to your web browser and stored there for later retrieval. 

Cookies may be small files or other types of information storage. There are different types of cookies: a) Essential Cookies. Essential cookies are cookies to provide a correct and user-friendly website; and b) Non-essential Cookies. Non-essential Cookies are any cookies that do not fall within the definition of essential cookies, such as cookies used to analyze your behavior on a website (“analytical” cookies) or cookies used to display advertisements to you (“advertising” cookies). 

Google Fonts

We integrate the fonts of the provider Google LLC, whereby the user’s data is used solely for the purpose of displaying the fonts in the user’s browser. The integration is based on my legitimate interest in a technically secure, maintenance-free and efficient use of fonts, their uniform display and taking into account possible licensing restrictions for their integration. The legal basis for this processing is our legitimate interest.

Font Awesome 

We integrate Font Awesome of Fonticons Inc, whereby the user’s data is used solely for the purpose of displaying the fonts in the user’s browser. The integration is based on our legitimate interest.

Links to other websites

Please note that if you use a link from our website to a third-party website, that third-party may also set new cookies that are not covered by this policy. In such cases, we recommend that you read the cookie policy on the third-party website itself.

 

Data we collect directly

Contacting us

If you contact us, we store and process the following data from you: Name, e-mail address, telephone number as well as other Personal Information that you provide when contacting us. This data is collected and processed exclusively for the purpose of contacting you and processing your request and then deleted, provided there is no legal obligation to retain it. The legal bases for processing are contract and our legitimate interest.

We are present on social media. If you contact or connect with us via social media websites, we and the relevant social media website are jointly responsible for the processing of your data and enter into a so-called joint controller agreement. The legal basis is our legitimate interest, your consent or, in some cases, the initiation of a contract.

When using our services

The protection of your Personal Information is particularly important to us in the performance of our services. We therefore only want to process as much Personal Information (for example, your name, address, e-mail address or telephone number) as is absolutely necessary. Nevertheless, we rely on the processing of certain Personal Information, to fulfill our contractual obligations to you or to carry out pre-contractual measures and in the context of administrative tasks as well as organization of our business, and compliance with legal obligations, such as archiving. 

Customer Information Protection

JVS General Construction is committed to the protection of all client information shared with us. All Personal Information you provide, whether by phone, email, contact forms, or through any of our platforms, is kept confidential and secured through administrative, technical, and physical safeguards. We do not sell, rent, or lease your information to third parties. We use industry-standard encryption and access controls to limit data exposure to only authorized personnel, and we maintain strict internal policies and training regarding information privacy.

Client Management, Booking and Business Management

We process data in the context of administrative tasks and the organization of our business using the services of HighLevel LLC, operating under the platform GoHighLevel. In this context, we process the same data that we handle in the provision of our contractual services (see below), which means that information (both personal and non-personal) and communications submitted to us are processed through the GoHighLevel platform. The legal basis for this processing includes the performance of a contract and our legitimate interest in efficiently managing our business operations and client relationships.

Online appointment booking

We use the services of HighLevel LLC (GoHighLevel) for the simplified booking of appointments. By using this service, the data you submit — including your name, email address, phone number, and IP address — is processed through the GoHighLevel platform. The processing of this data is based on our legitimate interest in facilitating appointment scheduling and initiating contractual relationships. The data you provide remains with us unless you request its deletion or the purpose for its storage no longer applies.

Testimonial 

Within the Testimonial section, we may display certain Personal Information, share certain details, knowledge and insights. When you approve and submit your Testimonial to us your consent is obtained, and you have choices about the information in your Testimonial. 

The storage of Testimonials is based on your consent. You can revoke your consent at any time. For this purpose, an informal communication by e-mail to us is sufficient. The legality of the data processing operations already carried out remains unaffected by the revocation.

Service Reviews

We use the rating and review system of Google and Facebook to constantly improve our service. We offer our customers the opportunity to rate us via an independent portal, without us being able to influence this in any way. For this purpose, some data is transmitted to Google and Facebook. The integration is based on our legitimate interest, and we have no influence or control over the data collected and processed by Google and Facebook.

Marketing 

If you have provided us with consent to process your data for marketing or advertising purposes, we may contact you through the communication channels you have authorized — such as email.

You may provide your consent by selecting a checkbox on a form or, in some cases, consent may be inferred from your interactions or contractual relationship with us when there is a reasonable expectation of receiving marketing content.

Marketing communications typically include updates about our services, promotions, or company news and are sent via email. These communications are managed either by us or by contracted service providers. Every marketing message includes a clear method to unsubscribe or opt out.

 

SMS Communications

If you provide your mobile phone number and consent to receive SMS communications from JVS General Construction, we may send you text messages strictly related to your inquiries, scheduled appointments, service updates, or project-specific information.

We do not use SMS for marketing or promotional purposes.

Your mobile number will not be shared with third parties for marketing purposes. All collected data is handled in accordance with our Privacy Policy.

Economic analyses and market research

For business reasons, we analyze the data we have on business transactions, contracts, enquiries, browsing behavior etc., whereby the group of persons concerned may include contractual partners, interested parties, and users of our services.

The analyses are carried out for the purpose of business evaluations and market research. The analyses serve us alone and are not disclosed externally and processed using anonymous analyses with summarized and or anonymized values. Furthermore, we take the privacy of users into consideration and process the data for analysis purposes as pseudonymously as possible and, if feasible, anonymously (e.g., as summarized data).

 

Principles of processing Personal Information

Storage and Retention

As far as necessary, we process and store your Personal Information for the duration of our business relationship, which also includes, for example, the initiation and execution of a contract.

In addition, we are subject to various storage and documentation obligations, which result from the minimum statutory retention periods. The retention and documentation periods specified there are two to six years.

Security

Our website uses SSL or TLS encryption to ensure the security of data processing and to protect the transmission of confidential content, such as orders, login data or contact requests that you send to us. We have also implemented numerous security measures (“technical and organizational measures”) for example encryption or need to know access, to ensure the most complete protection of Personal Information processed through our website. 

Nevertheless, internet-based data transmissions can always have security gaps, so that absolute protection cannot be guaranteed. And databases or data sets that include Personal Information may be breached inadvertently or through wrongful intrusion. Upon becoming aware of a data breach, we will notify all affected individuals whose Personal Information may have been compromised as expeditiously as possible after which the breach was discovered.

Do Not Sell

We do not sell your Personal Information.

COPPA (Children Online Privacy Protection Act)

When it comes to the collection of Personal Data from children under the age of 13 years old, the Children’s Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, United States’ consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children’s privacy and safety online. We do not specifically market to children under the age of 13 years old.

CAN SPAM Act

The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations. To be in accordance with CAN SPAM, we agree to the following: If at any time you would like to unsubscribe from receiving future emails, you can email us, and we will promptly remove you from ALL correspondence.

Telephone Consumer Protection Act (TCPA)

If we process your Personal Data for the purpose of sending you SMS communications, such communications will be strictly related to service updates, scheduling, or project-related information. We do not send SMS marketing or promotional messages. You may opt out of receiving these communications at any time by replying or texting “STOP” to any message. In accordance with the TCPA, your consent to receive SMS communications is voluntary and not a condition of doing business with us.

Controls For Do-Not-Track Features

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (‘DNT’) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, our website does not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this policy.

Sharing and Disclosure

We will not disclose or otherwise distribute your Personal Information to third parties unless this is a) necessary for the performance of our services including our shipping forwarder and, b) you have consented to the disclosure, c) or if we are legally obliged to do so e.g., by court order or if this is necessary to support criminal or legal investigations or other legal investigations or other legal proceedings; or proceedings at home or abroad or to fulfill our legitimate interests.

International Transfer

In the course of my website operation, we process data. We usually do not transfer Personal Information to countries outside the USA. However, if we do, we will make sure that processing of your Personal Information is governed by Processing Agreements that include Standard Contractual Clauses for a high level of data protection.

Access Request 

In the event that you wish to make a Data Subject Access Request, you may inform us in writing of the same. We will respond to requests regarding access and correction as soon as reasonably possible. Should we not be able to respond to your request within thirty (30) days, we will tell you why and when we will be able to respond to your request. If we are unable to provide you with any Personal Information or to make a correction requested by you, we will tell you why.

This Privacy Policy was last updated on Thursday, May 30th, 2025, and is the current and valid version. However, we want to point out that from time to time, due to actual or legal changes, a revision to this policy may be necessary.
